PLEASE READ THE FOLLOWING TERMS AND CONDITIONS OF USE CAREFULLY BEFORE USING THIS WEBSITE

All users of this website agree that access to and the use of this website is subject to the following Terms and Conditions. If you do not agree to these Terms and Conditions, please do not use this website.

This agreement is a contract between:

• you (the “customer”)
• New Horizon Wines Limited with registered business name Audacity Wines Retail (“New Horizon Wines”, “NHW”, “Audacity Wines”, “we”, or “us”).

New Horizon Wines Limited (Company No. 131499) is a company incorporated in Mauritius and operates under the Mauritius Liquor License number 8030047746, owns the website, shop.audacitywines.mu, and is the supplier of goods via this website.  The Audacity Wines boutique is situated at Flacq Shopping Mall, Boulet Rouge, Flacq.

Persons under 18 years of age are not permitted to place orders for alcohol.  Audacity Wines supports the responsible selling of alcohol and recommends that alcohol be consumed only in moderation.

The Terms and Conditions under which you may purchase goods from this website are set out below.

We reserve the right to update these Terms and Conditions at any time, without notice.

Registration

1. To place an order for goods your contact details are required to effect delivery.
2. You may optionally register on this website by selecting “Create Account” and completing the customer registration process.
3. By creating an account and using the services available on this website, you confirm that: 

• You have read and understood these Terms and Conditions;
• You agree to all of the Terms and Conditions;
• You are 18 years old or above; and
• If you buy the goods for a third party, that the recipient is also 18 years old or above.
• You are responsible for keeping your personal details updated.
• You agree to take responsibility for the safekeeping of the password chosen when creating your account.  If any unauthorised person uses your password you are liable for their use and you agree to release and forever indemnify NHW in relation to any liability howsoever arising out of the unauthorised use of your password.
• You are responsible for all activities and orders placed on your Audacity Wines account.
• If you believe an authorised third party has gained access to your registered account, please contact us at flacq@audacitywines.mu immediately.
• We reserve the right to suspend or cancel your account at any time, including but not limited to where you are suspected of having breached the security and/or the Terms and Conditions of this website.
• You may deregister from this website at any time by emailing us at flacq@audacitywines.mu with “Deregister Audacity Wines Account” as the subject of the mail.

Goods

1. Goods includes wines, spirits, sake, cider, soft drinks and any other product available for sale on this website.
2. Whilst all due care is taken regarding the images of the goods on this website, it is not guaranteed that they are an exact replica of the goods to be supplied.  Therefore, the images should be used as a guide only and are not contractually binding on Audacity Wines.
3. Any tasting notes are provided for guidance only and are not contractually binding on Audacity Wines.
4. We draw your attention to the fact that any food and wine pairings are suggestions only and are not contractually binding on Audacity Wines.
5. The goods on offer will depend on the availability of stock which may become depleted at short notice.  In this case an alternative may be suggested or you can cancel your order.
6. If there is an option to add a comment to us with your order, it will be taken into consideration to the extent possible but we cannot guarantee that all requests will be fulfilled.

Prices

1. All prices quoted are in Mauritian Rupees (Rs) and are inclusive of Value Added Tax (VAT) applicable at the time of your order.
2. The applicable delivery charges (refer “Delivery” below) will be added to the total price of the goods at the time of payment.
3. Our goods are sold at the price advertised on the website at the time of your order.  We reserve the right to change the prices at any time prior to receipt of your payment, without notice.

Payment

1. We accept payment by Visa, MasterCard and American Express.
2. Your credit card details are not recorded on our database and are managed solely by the 2Checkout payment gateway.
3. At check-out, your credit card is automatically debited with the total payment due.
4. Once payment is cleared, you will receive an automated confirmation email of your order.  At that stage, you will not be able to add extra goods to that particular order.
5. Payment must be received in full prior to goods being dispatched.

Delivery

1. Deliveries are only made in Mauritius.  At present goods cannot be delivered to any other country.
2. Only one delivery address is permitted per order placed.
3. Door-to-door delivery is charged at the rate of Rs 250 (inclusive of VAT).  There will be no delivery charges for orders above Rs 3,000.
4. Delivery will be made within 48 hours of receipt of your cleared payment (Monday to Friday but excluding public holidays).
5. Delivery is made on business days (Monday to Friday but excluding public holidays) between 8.30am and 5pm unless a special delivery arrangement is mutually agreed between you and Audacity Wines.
6. The customer will be contacted by phone or email to schedule a delivery time.  However, if no one is present at the delivery address at the agreed time, we shall call the customer again and endeavour to make a second delivery attempt on the next working day.   Should the delivery be unsuccessful on this second attempt, an additional delivery fee will apply.  No refunds will be available where delivery arrangements are not adhered to.
7. Delivery will be considered complete upon receipt of signature of the customer (or of his/her representative) and no claim whatsoever will be accepted thereafter.
8. Anyone at the delivery address who receives the goods shall be presumed by Audacity Wines to be authorised to receive the goods on your behalf.
9. Deliveries will not be made to persons under 18 years of age.  Photographic proof of age may be required e.g. National Identity Card, passport or drivers licence.
10. Upon delivery of the goods to the customer’s chosen address, the risk and title of the goods passes to the customer.
11. We will not be liable for the late or non-delivery of the goods or for any loss, damage and/or prejudice suffered as a result of your not being available at the agreed delivery time or any incorrect delivery occasioned by events beyond our reasonable control.
12. You may collect your order from Audacity Wines boutique at Flacq Shopping Mall, Boulet Rouge, Flacq.

Promotions

1. Audacity Wines may offer specials, promotions and discounts on this website. These promotions are available only while stocks last unless otherwise advertised.
2. We reserve the right to withdraw or vary our offers and promotions at any time, without notice.

Website technical issues

1. We endeavour to provide you with the best service possible.
2. We cannot, however, guarantee that the service will be free from technical problems at the website level. If you experience any technical issues, please contact Audacity Wines Customer Service on +230 489 6861 between 10am and 5.30pm (Tuesday to Saturday) and 10am and 2pm (Sunday) or by email at flacq@audacitywines.mu and we will remedy the situation as soon as reasonably practicable.
3. There may be restricted access to the website during periods of repairs and/or maintenance.
4. For internet safety purposes, we encourage you to install firewalls and antivirus programs on your computer.  We are not responsible for any failure of the internet or for any external intrusion.

Notification of Changes

NHW may add to, delete, or otherwise change any of these Terms and Conditions without notice.  In case of a modification, the pre-existing Terms and Conditions continue to apply to any goods ordered via the website before the change takes effect.

Data protection and Privacy

1. NHW is committed to respecting the privacy of your personal information.  Please refer to our Privacy Policy, which is available on this website.
2. By registering with Audacity Wines and ordering from us, you consent to us collecting and recording your personal data to process your orders and improve our services.  All data is collected lawfully, in accordance with the Data Protection Act 2004.
3. You may copy or store the content of this website only for your own personal, non-commercial use, provided you keep intact all copyright and proprietary notices.
4. It is strictly prohibited to make use of this website other than for the viewing of information displayed on this website, or for ordering purposes.

Intellectual property

1. The content of this website is protected by copyrights, trademarks, database and other intellectual property rights.
2. Audacity Wines may at times include links to third party websites.  We are not responsible for the content of linked websites.  If you have any concerns with the content of linked websites then please notify us by email at flacq@audacitywines.mu.
3. We may occasionally display material sourced from a third party.  Audacity Wines does not represent the accuracy of that material.

Applicable law

1. The relevant laws of Mauritius will apply to these Terms and Conditions and the courts of Mauritius will have exclusive jurisdiction.
2. If any of these Terms and Conditions are found to be unlawful, invalid or unenforceable, it will not affect the remaining Terms and Conditions.  These will continue to be valid and enforceable to the fullest extent permitted by Mauritian law.
